That would allow Kaepernick's attorneys to seek federal subpoenas under the Federal Arbitration Act.

Such a formal legal process would not be necessary, according to the person familiar with the case, if the White House would agree to the depositions.

That last point is significant as the President's legal team has already had a back-and-forth with special counsel Robert Mueller stating that he can't be compelled to testify.

The argument to the arbitrator and, potentially, to a federal judge would be straightforward: Trump's conversations with several National Football League owners and his rhetoric over the kneeling protests make his testimony vital to Kaepernick's case.

Yahoo Sports reports that those conversations "are expected to shape the requests to force the testimony of Trump, Pence and other affiliated officials, sources said".
