The Trump administration says Obamacare is unconstitutional: What it means to you

What they did: The Department of Justice filed a brief Thursday in support of the suit, saying "this Court should hold that the ACA's individual mandate will be unconstitutional as of January 1, 2019", and that some other provisions of the law - including those protecting people with pre-existing conditions being denied coverage or charged higher premiums - are inseparable from the mandate and therefore should be declared unconstitutional as well.

Under these provisions of the law, insurance companies can not deny coverage or charge higher rates to people with pre-existing medical conditions.

In a brief filed in a federal court in Texas, the department said a tax law signed previous year by President Donald Trump that eliminated penalties for not having health insurance rendered the so-called individual mandate under Obamacare unconstitutional. These two provisions, along with rules that allow children to stay on their parents' health plan until they are 26 years old, have proven popular with Americans. These are lawyers who have made arguments they personally disagreed with countless times.

Sessions said he agreed with the plaintiffs that without the mandate, the decision in the 2012 National Federation of Independent Business vs. former Health and Human Services Director Kathleen Sebelius, is the proper course.
