Alfie Evans case: Court rules against parents again

Pope Francis used his traditional Sunday blessing in St Peter's Square to say he's praying for British brain damaged toddler Alfie Evans.

Court of appeal judges ruled yesterday that Tom Evans, 21, and Kate James, 20, could not take their son Alfie Evans overseas to receive treatment for a rare degenerative brain disease.

The latest challenge came as Alder Hey children's hospital employed extra security personnel because of demonstrations in support of the toddler's parents.

"We're never going to give up on you, Alfie".

In the early hours of this morning, the force confirmed it was present while clarity was sought over Alfie's care with the judge who had overseen previous court hearings on his future.

Mr Evans and Ms James have apologised to families and staff at the hospital following reports of intimidation by protesters. This led to the hospital restricting the number of visitors to Alfie.

"It's not over", Tom said.

Alfie Evans has been battling an un-diagnosed degenerative brain disease.

The couple, from Liverpool, have already lost cases in the high court, court of appeal, supreme court and European court of human rights.

Appeal court officials said an appeal court judge had decided that Alfie should continue to receive treatment pending the outcome of Monday's Court of Appeal hearing.

They also suggested that Alfie was being unlawfully detained at Alder Hey. The court expressly determined that it would be lawful, because treatment would be in Alfie's best interests and that no other available course would be.

Lord Justice Moylan said that it was wrong for Alfie's parents to say that their own views trumped the best interests of the child.

The parents lost their bid to allow Alfie to be taken overseas for treatment. He said that Alfie "tried his best to stay awake but after a couple of minutes and a couple of very exhausted kid flickers he went back of to sleep".

Barrister for the parents, Paul Diamond, said the couple might make a further appeal to the Supreme Court.

A date was set last week at London's High Court to terminate Alfie's life support but it was not made public for legal reasons.

Speaking outside the hospital, Alfie's dad declared "it's not over" while crowds of supporters chanted "get him out".

Police said the "large" and "peaceful" protest in Liverpool on Thursday night "did cause significant traffic disruption and inconvenience for other people trying to access the hospital".

As for Alfie's future prospects, staff at Bambino Gesu have offered to perform a tracheotomy to improve his aided breathing and a percutaneous endoscopic gastrostomy so that he can be fed through his stomach.

Hayden said details of that plan could not be revealed because Alfie was entitled to privacy at the end of his life. "Treatment is futile as experts both here and overseas agree".
