After a University investigation and an appeal of that investigation found that Jaeger had not violated applicable University policies, the group filed a complaint with the U.S. Equal Employment Opportunity Commission on August 30, 2017.

Seligman said he made his decision before seeing the committee's report on the case involving Professor T. Florian Jaeger that caused turmoil in the prestigious Brain and Cognitive Sciences Department.

"The University's investigations relating to Jaeger in 2016 were conducted in good faith, impartially, professionally and in accordance with UR Policy 106", the report states. Yet, she said, her firm's conclusions are legal, not "moral" ones. The professors argue that this is a fatal flaw.

The report recommends a series of policy changes for Rochester, including moving to prohibit all student-faculty relationships within departments - changes that investigators said would put the institution ahead of its peers on that issue. The report agreed with the University's initial determination that Jaeger had not violated any policy.

Attorney Ann Olivarius, who represents the complainants, calls the report incomplete and inaccurate.

Pollak also said he felt that White missed the point in saying that professors involved in the federal complaints were not retaliated against because their careers progressed.
