Court orders that Zuma must face corruption charges

Newsflash: SCA rules against Zuma and NPA in spy tapes appeal

The Supreme Court of Appeal (SCA) in Bloemfontein has dismissed the appeal by President Jacob Zuma and the National Prosecuting Authority (NPA) in the spy tapes saga.

This comes after the Supreme Court of Appeal upheld an earlier decision by the High Court that Zuma be prosecuted with 18 charges and 783 counts of fraud, racketeering and money laundering.

The High Court in April 2016 ruled that the 2009 decision to withdraw the 783 charges was irrational and should be set aside, which had the automatic effect of the charges being reinstated against the president.

He said the picture that emerged was one in which Deputy National Director of Public Prosecutions Willie Hofmeyr and Mpshe were "straining to find justification" for discontinuing the prosecution. That would leave the decision in the hands of NPA boss Shaun Abrahams‚ who is seen as a Zuma ally.

Leach had scathing words for Mpshe's decision, rubbishing his claims that former head of the Scorpions, Leonard McCarthy, manipulated the timing of Zuma's indictment. Zuma's counsel Kemp J Kemp SC hinted that their next move would be to approach the NPA to once again consider Zuma's representations.

Legal expert Ulrich Roux said the court's decision means it was now the NPA's prerogative to reinstitute the charges against Zuma.

When the parties argued the case three weeks ago, they conceded that Mpshe had relied on an incorrect provision in law to base his decision on. "There is no reason why Zuma should not be prosecuted".

Mpshe's decision was immediately challenged by the Democratic Alliance (DA) in a case that dragged on for 8 years.
