Fresh twirl as court orders IEBC to include Aukot in Oct 26 poll

The opposition says the changes to the law are meant to make the transmission of election results a manual process that would have fewer safeguards against fraud, and would make it more hard for the court to annul an election. The Act awaits the signing of the President to become law.

His ruling means President Uhuru Kenyatta may still have a challenger on October 26, when the re-run is scheduled despite the withdrawal of top opposition candidate on Raila Odinga over allegations of bias.

Uhuru Kenyatta and Raila Odinga were due to face off in a repeat election later this month after the Supreme Court annulled an August ballot - in which the president Kenyatta was declared the victor - due to election irregularities and ordered the election to be conducted within 60 days.

On Tuesday Mr Odinga said that he was pulling out, accusing the election commission of failing to deliver reforms.

This follows yesterday's high court ruling that the October 26 election was a fresh poll and not a run off.

Justice John Mativo said he did not see any reason for Ekuru Aukot to be barred from participating in the repeat election. "They, however, have not submitted the statutory Form 24A", the IEBC noted in a statement obtained by Citizen Digital.

Kenya's Supreme Court last month annulled the August election citing widespread irregularities in the counting process and mismanagement by election officials, and called for a rerun within 60 days.

That judgement stated that if a candidate dies or withdraws from the fresh election, the IEBC must begin presidential nominations from scratch.
