Mum who accidentally smothered baby sues hospital for $8.6m

Monica Thompson, 42, claims nurses who worked at the Portland hospital put her three-day-old son in bed with her to be fed, even though she was still "groggy" from zolpidem and vicodin.

The lawsuit states Thompson gave birth to Jacob at the hospital on August 2, 2012.

The suit - which has been filed on behalf of Jacob Thmopson - seeks damages for the baby's "desperation and anxiety" as he was suffocated and his mother's "severe emotional distress upon unintentionally killing her firstborn child".

Monica Thompson was medicated with Ambien and Vicodin a few hours before a nurse walked into Thompson's room, gave her the baby and left around 3 a.m. on August 6, 2012, according to the suit.

Left alone without supervision, she claims she woke up some time later with the infant unresponsive in her arms, according to a heart-rending lawsuit filed by the Thompsons.

She called for a nurse while she tried on her own to help him. When she touched his eyes, talked to him, and poked him, she did not get a response, according to the lawsuit against the hospital.

"She called for a nurse while she tried to get him to respond", the suit said.

Doctors said baby Jacob suffered a catastrophic brain injury from lack of oxygen.

A new mother is suing a United States maternity hospital for $14 million after she rolled on her new baby and smothered him in her sleep.

The lawsuit says Jacob was born via C-section and was a healthy baby boy with no conditions. The lawsuit says the hospital gave Thompson "a combination of narcotic pain killers and sleep aids" at around midnight, and then brought Jacob back in three hours later so Thompson could breastfeed him.

After six days, doctors told the parents the baby's comatose state was irreversible. She's also asking for another $100,000 for medical and counseling expenses.

Johnson also said in a statement that Adventist Medical Center is committed to providing quality, compassionate care to all of their patients and that the hospital is reviewing the claims being made.

Jacob was not breathing, but the medical team was able to stabilize him and placed him on life support. She said they were unable to provide any additional information at the time.

They also recommend placing babies in the same room where the parents sleep but not the same bed, breastfeeding as much and as for long as mothers can (reduces risks of SIDS), keeping babies away from smokers and places where people smoke, and keeping the baby at comfortable temperatures as hot temperatures increase the risk of SIDS.
