The Trump Administration's H-1B Visa Changes Are Creating Uncertainty Among Employers

Trump went to Kenosha, Wisconsin, on Tuesday where he signed an order dubbed "Buy American, Hire American", ordering the Labour, Justice and Homeland Security Departments to propose reforms to the visa programme to prevent immigration fraud and abuse.

The executive order aims to shift the visa program from a lottery system to targeting jobs with a high need for skilled workers. The company has used existing visa waiver laws in order to fill positions with foreign workers in Trump properties such as Mar-a-Lago and Trump Winery.

Not yet, since there is no direct action to that effect in the order, but there is an invitation for reform proposals from USA agencies in view of the programme.

The President said H1B visas should be given to the most-skilled and highest-paid applicants, and they should never be used to replace Americans. The new policy, to be signed by Donald Trump in Wisconsin, will keep them (Indian companies) in check and provide a uniform access to all the well-qualified graduates all over the world'.

The H-1B visa program is important to colleges both because many global students look to it as a route to permanent residency in the USA and because universities use H-1Bs to hire postdoctoral researchers and others from overseas. To qualify for the visa, workers usually must have a bachelor's degree or higher.

On the campaign trail, Trump repeatedly vilified companies that looked to hire foreign workers.

Nasscom reiterated the point that persistent myths surrounding H-1B visas as cheap labour or displacing American workers as inaccurate. Most Indian IT companies get over 60 per cent of their revenues from the North American market.
