Immigration officials say they have taken a man who was accused of having sexual contact with a student in a Twin Cities high school into custody.

Prosecutors chose to defer charges to allow more time for police investigation on the case, according to a spokesman for the Hennepin County Attorney's Office.

On Wednesday, when Manito arrived at the school, he lied at the school's security desk about where he was headed and went to meet up with the student.

"What's really concerning is that, had I not followed him along and asked him why he was here he would have just left the building", Shirola said. They then met again a short time later in the same bathroom for a second encounter.

The question remains whether or not Manito committed a crime, as the student is an adult. At that point a group of students concerned about the special needs boy entered the bathroom, saw what was going on and alerted staff.

At a Friday press conference, Brooklyn Park Deputy Chief Mark Bruley said both Manito and the student were cooperating with investigators. Brooklyn Park police continue to investigate the incident, but do not expect to provide any updates on the case until Thursday morning.

"While they both were adults, they have to be consenting and able to consent to sexual acts", Bruley said.

Earlier, police said the man had a Washington state driver's license and travels around the country. "Anoka-Hennepin schools is really serious about protecting the safety and security of our students".
