A Los Angeles judge will hear arguments Monday on whether Roman Polanski's 40-year-old child-rape case should finally come to an end.

"I'm all for the truth getting out".

Braun has given a lengthy recitation of allegations of past judicial misconduct in his court filings but said Monday he did not want to litigate those issues.

Polanski's lawyer Harland Braun said his client's crime was "indefensible" but he fled at the time because he was "lied to" by the court about the sentence he would receive. Prosecutors objected to what they called a defense request for an "advance preview" of how much time Polanski would face if he returns to the United States for sentencing.

Polanski, now 82, has been forgiven by the young teenager he reportedly plied with champagne and forced himself upon.

Polanski's lawyer, Harland Braun, said he was trying to find a solution for a unique case, while a prosecutor said the Oscar victor was trying to get special treatment and dictate how the case proceeds from afar. Instead, the judge ordered Polanski to undergo a 90-day diagnostic study at a state prison in Chino before being sentenced. "Mr. Polanski intends to return to Los Angeles to both conclude this litigation and visit Sharon Tate's grave", Braun said, according to a Bloomberg report. All of which refused requests to extradite him back to America.

The case of French-Polish Polanski has been a cause celebre for 40 years. The request was denied by judges who previously were assigned to the case, but upheld by a California appellate court based upon the fact the wealthy celebrity remains a fugitive.

A hearing is scheduled for Monday, and Polanski's representation are now requesting he be tried in absentia. "I am only interested in obtaining the Gunson transcript and obtaining a ruling on whether a California court will respect the ruling of the Polish Court", he wrote in a February 21 email, which referred both to the testimony and to a determination in a Polish extradition hearing that Polanski should remain free.

Polanski won the Oscar for best director for 2002 film The Pianist and earned nominations for 1974′s Chinatown, starring Nicholson, and 1979 film Tess.
